According to the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language,” labeling must be in the state language. Along with the Ukrainian text, it is allowed to duplicate information in other languages, as well as to use abbreviations and symbols.
The information on the package must be clear, readable, indelible and can be placed in the form of a sticker, tab, tag or card.
Packaging artworks – graphic files and/or photographs – are subject to mandatory notification to the competent authority. The responsible person is responsible for the compliance of the labeling with the legal requirements.
Each distributor (except for the manufacturer and importer) is obliged to check the presence of all mandatory information on the packaging before placing the product on the market.
Mandatory labeling elements according to the Technical Regulations:
- name and address of the responsible person;
- country of origin (for imported products);
- quantity of contents (weight, volume or number of units);
- expiration date or use-by date after opening;
- storage conditions;
- warnings and precautions;
- special information for professional use;
- batch number or other identification data;
- intended use (if not obvious);
- list of ingredients.
If the product contains ingredients, colorants, preservatives or UV filters listed in Annexes 3-6 to the Technical Regulations, the labeling must contain appropriate warnings.
In addition, specific labeling requirements may be established by other laws, such as the Law of Ukraine “On Consumer Protection”, or by regulations for certain categories of products (e.g., aerosols, children’s cosmetics, etc.).
Before placing a product on the market, the responsible person must notify the graphic labeling (and, if necessary, photographs of the packaging). Registration is carried out by the Ministry of Health of Ukraine.
The cosmetic product must be sold exclusively in the packaging that corresponds to the notified artwork. Any non-compliance may indicate potential falsification or quality issues, which may lead to measures by market surveillance authorities.
The Technical Regulation also allows the use of graphic symbols to reduce the duplication of textual information in different languages.
